April 2022: The MDL Paraquat class action judge will have a status conference on April 1st to review where the litigation is headed and how best to take the bellwether lawsuits forward for trial in November 2022. 44 new paraquat lawsuits have been added to the MDL in the last two weeks. At this pace, April 2022 will be the busiest month for new files yet. Last week, the parties filed their class-action bellwether picks with the Paraquat MDL judge. Those choices, however, have not been made public.

May 2022: In the last month, over 50 new cases have been added to the Paraquat Lawsuit Multidistrict Litigation (MDL). A group of six patients was recently selected by the Paraquat MDL court for the initial Paraquat Parkinson's disease bellwether trials. As a result, the first trial in November 2022 is approaching soon. The strategy is to select 16 paraquat claims from among the almost 1000 Parkinson's disease litigation claims filed. Following some limited fact discovery in these instances, paraquat attorneys on both sides submitted a preference list to the MDL court, ranking the 16 cases in order of priority. Attorneys for plaintiffs seek the finest facts for their clients, while defense attorneys want the worst. The judge whittled the list down to six Paraquat claims based on these rankings.

Notable Cases:

CA Institutions Held Accountable

In October of 2024 the Archdiocese of Los Angeles recently reached a landmark $880 million settlement, compensating 1,353 victims who reported sexual abuse by clergy members. This settlement, one of the largest of its kind in U.S. history, is the latest step in addressing longstanding allegations involving hundreds of abuse cases. Many of these claims became eligible for filing due to California’s Assembly Bill 218, which temporarily extended the statute of limitations for such cases

California has seen several other recent verdicts in cases involving juvenile hall sexual abuse, reflecting a shift toward holding institutions accountable for failing to protect those who are most vulnerable. These cases often involve substantial compensation awarded to victims, as courts recognize the lifelong harm inflicted by abuse in state-managed juvenile facilities. The trend in California is to view the state and its agencies as liable for allowing such abuse to occur, resulting in significant verdicts that underscore the importance of accountability in juvenile justice.

The Central California Women's Facility (CCWF) in Chowchilla has faced serious allegations of sexual abuse by correctional staff. Over the past decade, incarcerated women have reported incidents ranging from inappropriate groping to forcible rape. In the last two years alone, hundreds of private lawsuits have been filed, highlighting the systemic nature of the abuse.

Gregory Rodriguez, a former correctional officer at the Central California Women's Facility in Chowchilla, has been charged with 96 counts of sexual misconduct, including rape, sodomy, sexual battery, and rape under color of authority. These charges involve at least 13 female inmates, with alleged assaults spanning from 2014 to 2022, intensifying in the latter years. Rodriguez retired in August 2022 following an internal investigation by the California Department of Corrections and Rehabilitation, which identified over 22 potential victims. If convicted on all charges, he faces a potential sentence exceeding 300 years in prison.

The U.S. Department of Justice (DOJ) launched a civil rights investigation in September 2024 into allegations of widespread sexual abuse by staff at California women’s prisons, specifically the Central California Women’s Facility in Chowchilla. The investigation aims to determine whether the California Department of Corrections and Rehabilitation (CDCR) has adequately protected incarcerated women from sexual misconduct by correctional officers. The inquiry was prompted by numerous reports and lawsuits detailing systemic abuse, including rape and sexual assault, over the past decade.
